The Financial Services Commission ('the FSC') announced today that the Supreme Court had earlier granted an Injunction restraining Starlight Marine Limited and its beneficial owners from undertaking unlawful activities and a Restitution Order in the sum of £250,000.
The FSC also announced that it is seeking to wind up Starlight Marine Limited, for the first time using new provisions in the Financial Services Commission Act 2006.
Starlight Marine Limited first came to the attention of the FSC when some UK-based investors contacted it, after having allegedly been sold shares by 'SG Financial'. This was purporting to be based in Madrid. 'SG Financial' had asked investors to remit payments for the purchase of shares to Starlight Marine Limited in Gibraltar. This company has never held a licence authorising it to carry on financial services business in or from within Gibraltar.
Speaking shortly after the announcement, Albert Yome, Manager of the Fiduciary Services and Enforcement division at the FSC said, "We are delighted with today's news. The FSC is acting in the interests of investors who may have suffered financial loss as a consequence of their dealings with Starlight Marine Limited. We will now seek to obtain the monies granted under the restitution order".
